  1. Scheduling & Operational Conditions
    All dive services are subject to change, delay, or cancellation due to:
  • Weather conditions
  • Tidal conditions
  • Mechanical issues
  • Safety considerations
  • Calendar alignment and operational logistics

Safety, environmental compliance, and operational feasibility take precedence over all scheduled services. Streamline Diving Northwest LLC reserves the right to reschedule services when conditions are not safe, environmentally compliant, or operationally feasible.

  1. Environmental Compliance – Clean Marina Washington
    In accordance with Clean Marina Washington environmental standards:
  • No hull cleaning will be performed if any antifouling paint sloughing is observed.
  • Any visible paint instability, soft coating failure, or active coating release will result in immediate suspension of hull cleaning services.

If paint instability is present:

  • Bottom cleaning of any kind will not be performed.
  • Only large, hard marine growth may be removed solely for the purpose of minimizing drag and allowing the vessel to safely transit to a shipyard.
  • No soft growth removal, scrubbing, or coating disturbance will occur.

Rates for work performed under this section:

  • Cleaning services are billed at $300.00 per hour, charged per minute.
  • Services requiring a tender or tools beyond cleaning (including, by example, anodes, prop removal, or similar tasks) are billed at $325.00 per hour, charged per minute.

Final determination of paint condition and service eligibility is made on site by the diver based on observed vessel conditions and compliance/safety requirements.

  1. Antifouling Paint Condition & Vessel Responsibility
    Vessels with antifouling coatings beyond their recommended service life, unknown coating history, or compromised paint systems may not qualify for hull cleaning. The vessel owner is solely responsible for maintaining a serviceable antifouling system. Streamline Diving Northwest LLC assumes no liability for paint failure discovered during or after service when coatings are determined to be unstable or beyond serviceable condition.
  2. Cancellation Policy
    To protect scheduled dive windows, travel allocation, and tide planning:
  • Cancellations made more than 24 hours prior to scheduled service: No charge.
  • Cancellations made within 24 hours of scheduled service: A cancellation fee will apply.

Cancellation Fee Structure
The greater of:

  • 15% of the scheduled service total
    OR
  • $65 minimum

This fee compensates for reserved scheduling, tide coordination, and mobilization planning. The parties agree this fee is a reasonable estimate of scheduling/mobilization costs and is not a penalty.

Subscription Services
For customers enrolled in prepaid or subscription service packages:

  • Cancellation within 24 hours or early termination of remaining scheduled services will result in a charge equal to 15% of the value of remaining unused services.
  • This amount will be deducted from any applicable refund.
  1. Access & Readiness
    The vessel owner is responsible for:
  • Providing safe and unobstructed access to the vessel
  • Confirming dock or moorage permissions
  • Disclosing known hull, paint, or mechanical issues
  • Ensuring the vessel is present at the scheduled location and time of service

If the vessel is not present at the scheduled service location and time, if access is denied, or if site conditions are unsafe upon arrival, the cancellation policy may apply.

  1. Limitation of Liability
    Streamline Diving Northwest LLC performs services in accordance with accepted professional diving and marine service standards.

To the fullest extent permitted by law:

  • Liability is limited to the amount paid for the specific service giving rise to the claim.
  • This limitation applies to the fullest extent permitted by law and does not apply where prohibited by law, or to gross negligence or willful misconduct.
  • The company is not responsible for pre-existing hull or coating conditions.
  • The company is not responsible for latent structural defects.
  • The company is not responsible for mechanical failures unrelated to service.
  • The company is not responsible for shipyard repainting or repair costs.
  • The company is not responsible for environmental conditions beyond reasonable operational control.
  1. Governing Law & Venue
    This agreement shall be governed by and interpreted in accordance with the laws of the State of Washington. Any dispute arising out of or relating to services provided by Streamline Diving Northwest LLC shall be brought exclusively in a court of competent jurisdiction located in Kitsap County, Washington.
  2. Severability
    If any provision of this Service Disclaimer & Operational Policy is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
  3. Customer Acknowledgment & Binding Agreement
    By scheduling service, submitting payment, confirming a booking, or authorizing service, the customer affirms that they have read, understand, and agree to this Service Disclaimer & Operational Policy in its entirety.

The customer specifically acknowledges and agrees to:

  • Environmental compliance restrictions regarding antifouling paint sloughing
  • The hourly rates and billing method where applicable ($300.00/hour billed per minute for cleaning; $325.00/hour billed per minute for tender/tools-beyond-cleaning services)
  • The cancellation fee structure
  • Subscription cancellation deductions
  • Vessel maintenance responsibilities

Agreement becomes binding upon booking confirmation.
